Guide to Building Legalization in Montenegro
Thousands of houses and buildings across Montenegro remain, legally speaking, invisible to the system. Even if you have lived in these properties for years, without a legally regulated status, they do not possess full market value. Consequently, they cannot be sold, inherited, or used as collateral for obtaining a bank loan.
Legalization is not just an administrative obligation — it is an investment that protects your property. In this guide, we explain how to navigate this process most easily in accordance with the current Law on Legalization of Illegal Buildings (effective date: August 14, 2025).
1. What is the First (and Most Important) Step?
Many owners believe the process starts at the municipal office. However, the administration cannot recognize your building until it is precisely mapped.
This is where a surveying company comes in. The first document required to initiate the procedure is the Geodetic Study for Surveying and Floor-Plan Elaboration (Elaborat geodetskih radova za snimanje i etažnu razradu objekta). This document must be prepared by a licensed surveying firm and certified by the competent regional unit of the Real Estate Administration (Uprava za nekretnine). It serves as legal proof of the exact dimensions, number of floors, and position of your building on the cadastral plot.
2. Procedure: The Road to the Property Title Deed (List nepokretnosti)
We have broken down the process into three simple steps so you know what to expect:
-
Fieldwork and Surveying: A surveying crew visits the site. Using state-of-the-art equipment, they perform a precise measurement of the building.
-
Preparation and Certification of the Study: Based on field data, the study is prepared in the office and submitted to the Real Estate Administration for certification. This is a technical process that we fully manage on your behalf.
-
Application to the Secretariat: With the certified study in hand, an application for legalization is submitted to the competent secretariat in your municipality.
3. Golden Rule: Is the Building Visible on the Orthophoto Image?
This is the point where the process often comes to a halt. Under current law, the core prerequisite for legalization is that the building is visible on the orthophoto image of Montenegro's territory taken in July 2025.
This legal framework was established to ensure systematic spatial planning and protect land as one of Montenegro's most vital resources. The orthophoto image serves as temporal proof that the building existed at the time of capturing, whereas anything constructed after that period is considered new construction and is not eligible for this process.
Expert Tip: Before incurring any expenses, let us check whether your building is visible on that image. That is step zero from which everything begins.
